Please read these Terms of Service ("Terms", "Agreement") carefully before accessing or using any service offered by Smarter Stream TV ("we", "us", "our"), operating at smarterstream.tv. By creating an account, starting a free trial, or purchasing a subscription, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Agreement to Terms

This Agreement constitutes a legally binding contract between you (the user) and Smarter Stream TV. It applies to all visitors, subscribers, free-trial users, and anyone else who interacts with our website or streaming service. We reserve the right to update these Terms at any time. Continued use of the service after notification of changes constitutes acceptance of the revised Terms.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to enter into this Agreement. By accepting these Terms you represent that you meet this requirement.

2. Service Description

Smarter Stream TV provides access to a subscription-based IPTV and video-on-demand (VOD) streaming service delivering live channels, sports, movies, and TV series across 160+ countries. The service is delivered via internet protocol to compatible devices including, but not limited to, Amazon Firestick, Android TV, Smart TV, Apple TV, iOS, Windows, macOS, and MAG set-top boxes.

We offer access to approximately 45,000+ live channels and 220,000+ VOD titles. Channel and content availability may vary by region and is subject to change without notice due to licensing constraints, server maintenance, or content provider restrictions.

The service requires a stable broadband internet connection (minimum 10 Mbps recommended for HD, 25 Mbps for 4K content).
We target 99.9% uptime but do not guarantee uninterrupted, error-free service.
Scheduled maintenance windows may temporarily affect service availability; we will endeavour to notify users in advance.
Content libraries, channel lineups, and features are subject to periodic updates and may change without prior notice.

3. Subscription and Payment

3.1 Plans and Billing

Subscriptions are available on monthly, quarterly (3-month), semi-annual (6-month), annual (12-month), and biennial (24-month) billing cycles. Prices are displayed in USD and are inclusive of the services described in the chosen plan. All prices are subject to change; any price increase will take effect at the next renewal cycle with prior notice.

3.2 Payment Processing

Payments are processed by our authorised third-party payment processors. By providing payment details you authorise us to charge the applicable subscription fee. You represent that you are authorised to use the payment method provided. We do not store raw card data on our servers.

3.3 Renewals and Cancellation

Subscriptions do not auto-renew unless explicitly configured to do so. You are responsible for renewing your subscription before its expiry date to maintain uninterrupted access. You may cancel your subscription at any time; refer to our Refund Policy for applicable refund terms.

3.4 Taxes

Prices displayed exclude applicable taxes, levies, or duties imposed by your jurisdiction. You are solely responsible for all taxes applicable to your purchase where we are not legally required to collect and remit them.

4. Acceptable Use Policy

Your access to the service is personal and non-transferable. You agree to use the service only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:

Sharing your login credentials with individuals outside your household or reselling access to third parties without a valid reseller agreement.
Circumventing, disabling, or interfering with any security or access-control features of the service.
Using automated systems, bots, scrapers, or crawlers to access, collect, or extract data from our service.
Attempting to reverse-engineer, decompile, or disassemble any software underlying the service.
Uploading, transmitting, or distributing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
Attempting to gain unauthorised access to our servers, databases, or networks.
Using the service in any manner that could impair, overburden, or damage our infrastructure or interfere with other users' enjoyment of the service.
Using the service to stream, broadcast, or redistribute content to additional users beyond your licensed connections.

5. Intellectual Property

All content available through the service, including live channels, VOD titles, and metadata, is owned by or licensed to the respective content providers and is protected by applicable copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to stream content solely for personal, non-commercial use during your subscription period.

The Smarter Stream TV name, logo, website design, and proprietary software are the exclusive property of Smarter Stream TV and may not be reproduced, modified, or used without our prior written consent. Nothing in these Terms transfers any ownership rights to you.

6. Third-Party Services and Links

The service may integrate with or provide links to third-party platforms, apps, or services (payment processors, analytics, CDN providers). We are not responsible for the content, policies, or practices of any third party. Your interactions with third-party services are governed by those parties' own terms and privacy policies.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMARTER STREAM TV DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SMARTER STREAM TV, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Smarter Stream TV and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your violation of any law or third-party rights, or your use of the service in a manner not authorised by these Terms.

9. Termination

We reserve the right to suspend or terminate your account and access to the service immediately, without prior notice or liability, if we determine in our sole discretion that you have violated these Terms or engaged in any fraudulent, abusive, or illegal activity.

Upon termination, your right to access the service ceases immediately. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimer of warranties, limitation of liability, and governing law) shall survive.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable international commercial law principles. For users in the European Union, mandatory consumer protection provisions of your country of residence apply and are not affected by this clause.

We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved amicably within 30 days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction, as permitted by applicable law in your country.

11. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
